1. Acceptance of Terms
By creating an account or using Myend ("the Service"), operated by Myend B.V., you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service. By completing registration, you confirm that you have read, understood, and accepted these terms.
2. Description of Service
Myend is an end-of-life planning platform that helps you organize your legacy, create directives, store important information, and communicate your wishes to trusted people. The Service includes AI-assisted planning through our assistant Justine, document generation for wills and directives, a secure encrypted vault for sensitive information, a Legacy Contact system with Proof of Life check-ins, and cross-platform access on mobile and web.
3. Eligibility & User Accounts
You must be at least 18 years old to use the Service. You must provide accurate and complete information when creating an account. You may only have one account per person. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@myend.com if you suspect any unauthorized use of your account.
4. Your Content & Ownership
You retain full ownership of all content you create in Myend, including messages, documents, directives, vault items, and personal information. You grant Myend B.V. a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service. We will never sell your data, use it for advertising, or use your content to train AI models. Upon account deletion, all your content is permanently removed from our systems.
5. AI-Assisted Features
Myend uses artificial intelligence powered by third-party providers (Anthropic for text, OpenAI for voice transcription) to assist with planning, document drafting, and guidance through our assistant Justine. Important: AI-generated content is provided as suggestions and guidance only. It does not constitute legal, medical, or financial advice. Justine is not a licensed attorney, doctor, or financial advisor. You are responsible for reviewing and verifying all AI-generated content. AI may produce inaccurate, incomplete, or outdated information. Documents generated through the Service (wills, healthcare directives, funeral plans) are planning aids and require proper legal review and execution according to your jurisdiction to have legal effect. Myend B.V. provides no guarantee of the legal validity of any generated document.
6. Legacy Contacts & Proof of Life
The Legacy Contact feature allows you to designate trusted people who can access specific information you choose to share after your passing, activated through the Proof of Life check-in system. You are responsible for keeping your Legacy Contact designations current and informing your contacts of their role independently. The Proof of Life system operates on automated check-ins and should not be relied upon as the sole notification mechanism for your passing. Myend B.V. is not responsible for actions taken by Legacy Contacts after activation, the timeliness of Proof of Life notifications, or any consequences arising from outdated or incorrect contact information. The Legacy Contact system is not a substitute for formal estate planning with a licensed attorney.
7. Document Generation
Myend helps you create planning documents including last wills, healthcare directives, funeral plans, euthanasia directives, and donor registrations. These documents are digital records of your wishes and planning aids. They are not inherently legally binding. Legal validity depends on your jurisdiction, and most jurisdictions require specific formalities (witnesses, notarization, registration) for documents to have legal effect. You must consult a qualified attorney in your jurisdiction to ensure your documents meet all legal requirements. Myend B.V. makes no representation about the legal validity or enforceability of any document generated through the Service.
8. Prohibited Uses
You agree not to: use the Service for any illegal purpose or in violation of any applicable law; create accounts for other people without their express consent; upload content that is defamatory, threatening, or infringes on the rights of others; attempt to reverse-engineer, decompile, or extract the source code of the Service; use automated tools (bots, scrapers) to access the Service; impersonate any person or entity; attempt to circumvent security measures or gain unauthorized access; or interfere with the proper working of the Service.
9. Intellectual Property
The Myend platform, including its software, design, branding, logos, and all related technology, is owned by Myend B.V. and protected by applicable intellectual property laws. You retain ownership of your content as described in Section 4. Nothing in these Terms transfers any intellectual property rights to you beyond the limited right to use the Service as intended.
10. Privacy
Your privacy is critically important to us given the sensitive nature of end-of-life planning. Our Privacy Policy, which forms part of these Terms, explains in detail how we collect, use, protect, and share your personal data. All user data is stored locally on your device first and synced to secure cloud storage with bank-level encryption.
11. Service Availability
Myend B.V. strives to maintain the Service available at all times but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible. The local-first architecture means your data remains accessible on your device even when our servers are unavailable.
12. Limitation of Liability
Myend B.V. provides the Service "as is" and "as available" without warranties of any kind, express or implied. We are not a law firm, medical provider, or financial advisor. To the maximum extent permitted by Dutch law, Myend B.V. shall not be liable for: any indirect, incidental, special, consequential, or punitive damages; the legal validity or enforceability of any document generated through the Service; actions taken or not taken by Legacy Contacts; loss of data beyond what is stored locally on your device; or damages exceeding the amount you paid for the Service in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Myend B.V. and its officers, directors, and employees from any claims, damages, or expenses arising from: your use of the Service; your violation of these Terms; your reliance on AI-generated content without professional review; or any content you upload to the Service. This indemnification survives termination of your account.
14. Termination
You may delete your account at any time through the Privacy & AI settings. Upon deletion, all your data will be permanently removed from our systems within 30 days. Myend B.V. reserves the right to suspend or terminate accounts that violate these Terms, with notice unless the violation requires immediate action. Sections regarding limitation of liability, indemnification, intellectual property, and governing law survive termination.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of The Netherlands. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved amicably through good-faith negotiation. If no resolution is reached within 30 days, disputes shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, The Netherlands.
16. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes at least 30 days in advance via email or in-app notification. Continued use of the Service after the effective date of updated terms constitutes your acceptance. If you do not agree with the changes, you may delete your account before the changes take effect.
17. Payment & Billing
Myend offers one-time purchases for the Starter plan ($19) and the Complete plan ($99). All prices are listed in US dollars (USD). Complete includes a $25/year maintenance subscription that begins after your first year and auto-renews annually; you can cancel it at any time through the billing portal in your account settings. Cancelling the maintenance subscription never removes access to the content you have already created — your directives, documents, vault items, and plans remain viewable and exportable forever. Only ongoing AI features and Proof of Life monitoring lapse when the subscription is not active. If you already purchased Starter, its full price is credited automatically when you upgrade to Complete. Because Myend gives you immediate access to digital content and services, you expressly consent at checkout to immediate performance and acknowledge that you thereby waive the statutory 14-day right of withdrawal (herroepingsrecht) under EU consumer law; purchases are final once completed. We may nevertheless offer a refund at our discretion — contact support@myend.com and we will listen. Nothing in this section limits statutory rights that cannot be waived. Payment processing is handled by Stripe, Inc.; we never store your card numbers.
